Terms and Conditions

This agreement outlines the Terms and Conditions (“Agreement”) applicable to the use of thec Pooraa website and services offered by BUSY Infotech Private Limited (“the Company”, “We”, “Us”). By accessing, downloading, installing, or using our software or services, you (“User”, “You”, “Your”) acknowledge that you have read, understood, and agree to be bound by this Agreement.

If you disagree with any of the terms, your sole recourse is to uninstall the software and discontinue its use. You are encouraged to reach out to our customer support team to address any concerns.

These Terms form a legally binding contract between You and BUSY Infotech Private Limited regarding your use of our software and services.

Definitions

  • Company – Refers to BUSY Infotech Private Limited

  • User/Client – Refers to any individual or organization using the Pooraa software, website, or associated services.

  • Services/Pooraa – Refers to all products and services provided by Pooraa, including Pooraa Order Management System, Production Software, mobile apps, and associated modules.

  1. Acceptance of Agreement

    You must be of legal age and authorized capacity to accept and enter into this Agreement. By using our services, you affirm your acceptance of these Terms. If you use Pooraa on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

  2. Description of Services

    Pooraa provides software solutions for business operations such as order management, production tracking, invoicing, and reporting. These services may be accessed via desktop, web, or mobile applications. You are solely responsible for maintaining the confidentiality of your credentials and the equipment or internet connection used to access Pooraa.

    You are granted a limited, non-transferable, non-exclusive license to use the software for your business purposes in accordance with this Agreement. All rights not expressly granted are reserved by Pooraa.

  3. Data Ownership

    Pooraa retains full ownership of all intellectual property, code, and services provided. However, you retain ownership of the content you upload or generate while using our software. Pooraa does not claim ownership of your data and will only access or use it as necessary to provide services.

  4. Trademark and Copyright

    All content, logos, trademarks, and materials associated with Pooraa are protected by intellectual property laws. Unauthorized use, copying, or reproduction is strictly prohibited.

  5. Collection of Information

    We collect data about your usage, device, location, and other identifiers to improve service quality. By using Pooraa, you consent to our data practices, including the use of cookies and analytics tools. This information is used to enhance performance and user experience.

  6. Communication and Promotions

    By using Pooraa, you agree to receive service-related communications via email, SMS, WhatsApp, RCS, or other channels. Promotional messages may also be sent, and you may opt out of these, except for critical service communications.

  7. Prohibited Activities

    You agree not to use Pooraa for illegal, unethical, or unauthorized activities. This includes distributing spam, malware, offensive or infringing content, or engaging in activities that harm Pooraa’s systems or reputation. Pooraa reserves the right to suspend or terminate access in such cases.

  8. User Accounts and Administration

    If you are managing Pooraa on behalf of an organization, you are responsible for managing users, administrators, and access control. Pooraa is not liable for internal disputes or loss of access due to mismanagement by your team.

  9. Usage Restrictions

    You may not:

    • Share, resell, lease, or sublicense Pooraa software
    • Modify, reverse-engineer, or create derivative works
    • Use the software for illegal purposes
    • Attempt unauthorized access to our infrastructure

  10. Indemnification

    You agree to indemnify and hold harmless Pooraa and its affiliates from any claims or liabilities arising out of your misuse of the software or breach of these Terms.

  11. Limitation of Liability

    Pooraa shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use or inability to use the services.

  12. Disclaimer of Warranties

    All services are provided on an “as-is” and “as-available” basis. Pooraa makes no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or reliability.

  13. Security

    You agree not to compromise the integrity, availability, or security of Pooraa services, systems, or networks. Unauthorized access or disruption attempts will result in legal action and termination of services.

  14. Inactive Account Policy

    We may deactivate free or unpaid accounts that remain inactive for a prolonged period. You will be notified prior to termination and given an option to back up your data.

  15. Hosting and Data Location

    Your data may be stored in servers located within or outside your country, based on availability and legal compliance. If discrepancies are found in location or access, Pooraa reserves the right to take corrective actions.

  16. User-Generated Content

    You are solely responsible for the content you publish or transmit using Pooraa. If you publish news or regulated content, you are responsible for adhering to the applicable laws and disclosure norms.

  17. Sample Files and Demonstrations

    Pooraa may provide sample templates, data sets, or demo files. These are intended for illustration purposes only and come with no warranty or guarantee.

  18. Suspension and Termination

    Pooraa may suspend or terminate your account for:

    • Non-compliance with this Agreement
    • Extended inactivity
    • Technical disruptions
    • Legal obligations

    You may terminate your account at any time. Termination will result in the deletion of all associated data.

  19. Product Updates and Availability

    Pooraa reserves the right to update, modify, suspend, or discontinue any service or feature without prior notice. Changes may include migration of features to paid tiers, subscription models, or discontinuation of legacy modules.

  20. Refund and Cancellation

    No Refunds will be processed for termination initiated by Pooraa due to breach of terms.

  21. Governing Law and Jurisdiction

    This Agreement shall be governed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

  22. Pricing and Subscription

    Features and modules are made available through an active Pooraa Subscription Plan. Access may be limited or revoked if the subscription is not renewed on time.
